Freedom of speech in danger?
When J. D. Vance, who had just become US Vice President, finished his speech at the Munich Security Conference in January 2025, the mood was subdued, and the European politicians in attendance, especially the Germans, looked confused. This was due to what the “second man in the US” had to say. In Germany, freedom of expression is in danger, and you can go to prison for a tweet critical of the government. This is an accusation that has been repeatedly made by leading US politicians, such as billionaire magnate Elon Musk and US Secretary of State Marco Rubio. The debate is being further fueled in this country following the fatal assassination of Turning Point USA activist Charlie Kirk on a university campus in September 2025.
In fact, there may be more to the accusation, which the Trump administration admits is cynical. Germany is slipping noticeably in independent rankings on freedom of expression and freedom of the press.
Investigations are being conducted against private individuals who make satirical and scathing comments on the internet about leading German politicians, such as (former) Federal Minister of Economics Robert Habeck (Alliance 90/The Greens) or Hamburg’s Senator of the Interior Andy Grote (SPD), which are perceived as excessive. Since the escalation of the Middle East conflict following the Hamas attack on October 7, 2023, both “pro-Israel” and “pro-Palestine” initiatives have complained that they are being “canceled.” There are increasing complaints about “cancel culture,” especially at universities, from various political spectrums.
Is freedom of expression in Germany really in danger?
We want to explore this question. To this end, we warmly welcome Prof. Christoph Enders, retired professor of public law, political science, and constitutional law. A brief introduction to the necessary legal foundations will be followed by an open discussion.
